Iraqi NGOs to create their NGO Law – Sign Now
The end of an independent civil society in Iraq?
The new Iraqi civil society law, that awaits ratification by the government, endangers the independence of civil society in Iraq. Iraqi NGOs are afraid that the government aims to monitor and control the funding and operations of NGOs. This fear has been strengthened in the last year, because the parliament failed to consult with NGOs when drafting the new NGO law. The current draft appears to be aimed at controlling NGO activities, rather than supporting the development of an autonomous and vibrant civil society The 2008 NGO law has been passed by the Shoura Council and is currently awaiting Cabinet approval. While the latest draft contains significant improvements on previous drafts, Iraqi NGOs remain concerned about certain aspects of the law, which could have serious implications for the future independence of Iraqi civil society and for international NGOs working in the Iraq context.
Summary of main concerns on the draft legislation:
•- No details provided as to the grounds under which the government can refuse registration of an NGO;
•- Once registration is complete, certification is valid for only two years;
•- NGOs must seek approval of the government before buying or selling property;
•- NGOs are required to provide financial and narrative reports to the authorities on an annual basis;
•- Any donations from inside or outside Iraq must first be approved by the government and all donors need to notify the government prior to making any funds available to NGOs;
•- The government has discretionary power to grant and remove benefits and additional rights and privileges to NGOs;
•- NGOs are required to submit their annual budget and a list of the organization’s assets to the authorities;
•- NGOs can only form and join networks with the permission of the government;
•- The executive rather than the judiciary has the right to suspend activities of an NGO;
•- Anyone who is member of unauthorized or dissolved NGO can be imprisoned for 6 months to 3 years;
•- International NGOs opening a branch in Iraq must provide names, addresses and telephone numbers of all international staff in Iraq and must notify the Department of NGOs of any staffing changes;
•- International NGO participation in Iraq NGO networks is limited to no more than 25%;
•- Any Iraqi NGO that wants to open a branch outside or inside Iraq must first obtain the approval of the Iraqi government;
•- NGOs are not allowed to register with ‘another party’ (this could cause problems for those operating and therefore registered in the Kurdish Region)
A vibrant independent civil society is important for any country, because it is the missing link in the creation of a successful social democracy. The only method to help Iraq to become a secure and stable nation in the heart of the Middle East, is empowering the civil society’s ability to mobilize people ,build their capacities and empower them for participating in building a new Iraq. This will enable communities to defend themselves from both tyranny and terror.
The efforts of non-governmental organizations to promote democracy and good governance rely on the ability to work in a free, independent environment without the control or the monitoring influence of any state, other than law.
•Therefore a new law needs to be created in cooperation with international and national NGO’s to provide Iraqi civil society with a suitable environment to work and cooperate their efforts with the government for the welfare of the Iraqi people.

مع عرض قانون المنظمات الغير حكومية في العراق على مجلس النواب العراقي للمصادقة تتوجس منظمات المجتمع المدني الخوف لكي لايتم تشريع ألية للتحول فيها الحكومة الى رقيب على عمل وتمويل المنظمات غير حكومية,وقد سبب عدم أستشارة المعنين والمتأثرين بالقانون خلال عملية أعداد مسودة القانون هذه المخاوف, لما تؤثر عدد من فقراته على أستقلالية عمل المجتمع المدني في العراق ويترك المجال لهواجس أن تكون الحكومة تريد أن تسيطر على عمل المنظمات غير الحكومية بدلا من دعمها لبناء مجتمع مدني فعال
أن مسودة الاخيرة تحوي على تعديلات كثيرة أفضل من سابقاتها,الا أن المنظمات غير الحكومية تظل قلقة حول عدد من النقاط التي لها أثار جدية في مستقبل العمل المستقل للمنظمات المحلية والدولية في العراق وأستقلاليتها
ملخص النقاط الرئيسية التي تثير قلق المنظمات في هذا القانون:
-لا تو جد تفاصي الى الأسباب التي بموجبها التي تقوم الحكومة بها برفض ترخيص المنظمة
-تراخيص عمل المنظمات فعالة لمدة عامين فقط من تاريخ التسجيل
-على المنظمات الحصول على موافقة الحكومة قبل بيع أو شراء أي عقار
-على المنظمات تقديم تقارير مالية وسردية بشكل سنوي للجهات الحكومية
-اي تبرع من داخل أو خارج العراق لابد أن يتم الموافقة علية من قبل الحكومة وعلى جميع المانحين أن يبلغوا الحكومة قبل عمل أي منحه للمنظمات
- للحكومة حق حصري لمنح أو رفع أي حقوق أو امتيازات تخص المنظمة
-المنظمات ملزمة أن تقدم ميزانية سنوية وقائمة بممتلكات المظمة للحكومة
-لاتستطيع المنظمة أن تكون عضو في أو أن توسس أي شبكة بدون موافقة الحكومة
-يتم أيقاف وسحب رخصة المنظمة بشكل مباشر من الحكومة بدون الرجوع للقضاء
-يتعرض للسجن كل من كان عضو في منظمة غير مسجلة او معترق بها قانونيا لمدة 6 أشهرالى 3 سنوات
- على أي منظمة دولية تريد فتح فرع في العراق تقديم أسم وتلفون وعنوان عامليها الدولين الموجودين في العراق وعليها أبلاغ دائرة المنظمات غير الحكومية بأي تغير في الكادر
- لاتزيد حق المنظمات الدولية للمشاركة في أي شبكة داخل العراق عن 25%
- اي منظمة عراقية يريد أن يفتح فرع داخل أو خارج العراق الحصول موافقة مسبقة من الحكومة
- لايسمح للمنظمات بالتسجيل في مؤسسة أخرى وهذا قد يسبب مشكلة للعاملين في أقليم كردستان وقد سبق لهم التسجيل في مكتب المنظمات الخاص بالاقليم
-
أن وجود مجتمع مدني قوي وفعال لأنه يمثل الحلقة المفقودة في المجتمع لأنجاع الديمقراطية ,وأن الطريق الوحيد لمساعدة العراق ليكون دولة مستقرة وامنه هو مجتمع مدني ذو قدرة على تحريك الشارع وبناء قدرات المواطنين وتقويتهم للمساهم في بناء المجتمع العراقي الجديد وصنع التغيرات ضمن المجتمع للوقوف بوجه الأرهاب والتسلط
أن جهود المنظمات الغير حكومية لنشر الأدارة الرشيدة والديمقراطية تعتمد على توفر بيئة مستقلة وحرة بلا سيطرة أو رقابة او تأثير لأي شيء غير سلطة القانون
لهذا نحن بحاجة لقانون يخدم المنظمات لخلق علاقة من المنظمات المحلية والدولية ضمن بيئة مناسبة للعمل مع الحكومة صفا واحدا لخير الأنسان العراقي
